This document sets out the terms and conditions (“Terms”) applicable to the purchase and use of website templates (“Templates”) created and sold by Brightfolk Studio Pty Ltd (ABN 18674482467) (“Brightfolk Studio”, “we”, “us”, “our”). By purchasing, downloading, or using a Template, you (“you”, “customer”, or “user”) agree to these Terms. These Terms form part of Brightfolk Studio’s broader Terms & Conditions and are governed by the laws of New South Wales, Australia.

1. Scope of Licence

Each Template is licensed to a single user for use in one (1) website only. Your purchase provides a limited, non-transferable, non-sublicensable, non-exclusive licence to use the Template for your personal or business website, or a client project (if you are a designer).

You may not:

• Use the same Template for multiple clients or multiple businesses.

• Share, distribute, resell, or sublicense the Template (modified or unmodified).

• Use the Template as a base for a new product or derivative product intended for resale.

You are permitted to:

• Customise the Template using Squarespace’s inbuilt editor.

• Use the Template for one (1) published website.

• Credit Brightfolk Studio in your site footer (optional, appreciated).

2. Payment & Delivery

Templates are sold via:

• One-off payment; or

• Payment plan, with up to 6 monthly instalments.

Access to the Template is provided upon receipt of payment (or first instalment, if applicable). Full payment is required even if you do not complete the setup or installation of the Template. Access may be revoked for non-payment or payment reversal.

Late payments may result in suspended access to future support or template updates.

3. Refunds & Australian Consumer Law

As Templates are digital and delivered instantly, we do not offer refunds for change of mind, personal dislike, or incorrect purchase. However, we will comply with all obligations under the Australian Consumer Law (ACL). If the Template is faulty, not as described, or fails to function as promised, you are entitled to a replacement, repair, or refund.

To request a remedy under the ACL, please contact us at hello@brightfolk.studio within a reasonable time of purchase.

4. Fonts, Images & Licensed Content

• Fonts: Only Squarespace’s inbuilt fonts are used. No third-party font licences are required.

• Images: Demo images shown in Templates include:

  • Images by Nat Spada (natspada.com) — used for demonstration only. These images may not be used, copied, edited, modified, or published on your final website.

  • Stock images from Unsplash and Pexels — available for your own use under their respective open licences. Alternatively, you may replace them with your own licensed content.

It is your responsibility to ensure any images you use in the final website are correctly licensed.

5. Support & Resources

Each Template purchase includes:

• 30 days of email support from date of purchase for technical or installation queries.

• A Launchkit (Google Doc) with guidance for:

  • Template walkthrough

  • Brand voice generator (ChatGPT link)

  • Visual hierarchy and layout advice

  • Website content writing prompts

Support is limited to issues related to the Template itself. We do not offer setup or design customisation services as part of this purchase unless otherwise agreed.

6. Intellectual Property & Ownership

Brightfolk Studio retains all intellectual property rights in the Template design and its components.

By purchasing a Template, you do not receive ownership of the design — only a licence to use it as per these Terms. You must not:

• Extract code or design elements for use in other projects

• Claim the Template as your own original design

• Remove copyright notices embedded in the Template (if present)

We reserve the right to revoke your licence without refund if you breach these terms.

We may display your finished website (if publicly available) in our portfolio or marketing materials unless you request otherwise.

7. Termination of Licence

Brightfolk Studio reserves the right to revoke your licence if:

• You violate these Terms

• Payment is not completed or is reversed

Upon revocation, you must:

• Cease use of the Template

• Remove any installed versions from public websites

8. Legal Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. By purchasing a Template, you agree to submit to the jurisdiction of courts in New South Wales for any disputes arising out of these Terms.
